Terms and Conditions

New and existing clients must please familiarise themselves with this crucial information stated as Terms and Conditions with working with JPDesign.
These Ts & Cs detail the rules that apply to to the start, duration and fulfilment of work between consumer/client and JPDesign.

OWNERSHIP OF MATERIALS 

*Copyright, creative and intellectual property (CCIP*) include:

mood boards/mock-ups/examples/rough drafts/design ideas/rough sketches/visual direction/in-person or text creative consultation/complete design options/complete design

   –  Copyright, creative and intellectual property (CCIP*) is retained by JPDesign on all design work including copy/words, pictures, ideas, visuals, mood-boards and rough illustrations unless specifically released in writing

  –  All designs presented to, and/or chosen by client and paid for,  remain as copyright and intellectual property of JPDesign.

  –   If designs are taken and/or purchased and resold and/or claimed as ones own, legal action surrounding copyright/ plagiarism infringement will be pursued.

  –   If a client has received any CCIP materials from JPDesign BEFORE receiving a formal quotation or paying the non-refundable deposit [eg a mood-board for visual direction] and does not want to proceed with the project, but is now in ownership of CCIP materials –  the client will be invoiced a CANCELLATION FEE of: Rate per hour worked on item/s up until notice.

 

DESIGN FEES, QUOTING AND RELEASE OF MATERIALS:

  –  Hourly Design Fee is currently charged at R480.00 per hour as recommended by SAFREA.

  –  Varying design fees will be included in quotations based on an estimate of time required to complete design.

  –  If a quote for design work is accepted (verbally or via electronic text) a non-refundable 50% deposit is required for design work to commence.  The remaining 50% of the project quotation total will be due upon confirmation of completion of the work and prior to the sharing/release/courier of materials with client.

  –   Additional work required outside of the initial and confirmed quote and visual brief will be charged for at standard hourly rate.  Additional work includes:  New designs required/change of visual brief  and/or Changes to initial design that exceed 60 minutes 

 

Materials will not be released/delivered/couriered until they are fully paid for or the 50% balance payable has not been paid for

 

TRADING HOURS:

Standard working hours/days incl: Mon-Friday, 09:00-17:00

Design / Production work required over weekends/Public Holiday will be charged for R520.00 per hour.

 

URGENT WORK

Projects exceeding 10 hours (alone, or alongside production) required for a deadline within:

      * 10-14 days of first contact will require a Rush Fee Surcharge of R 1 300.00

       * 7-9 days of first contact will require a Rush Fee Surcharge of R 1 700.00

       * 3-6 days of first contact will require a Rush Fee Surcharge of R 2 200.00

These are subject to project requirements. Manufacturing/laser cutting/availability of materials will determine if the project is feasible within the given/expected time frame. If the manufacturing/production/material availability/project volume is unable to fit within the time left, JPDesign has the right to decline the project.

CAPACITY

   –  JPDesign has the right to accept and prioritise clients and projects according to available capacity IN CONJUNCTION with clients deposit.

   –   If a client requests deliverables from JPDesign, the ability to proceed with the project and deliverables, within the confirmed time frame and deadline will be communicated. 

   –  JPDesign will accept a project based on the the initial scope of work required.

JPDesign has the right to:

   –  Charge additional fees if the deliverables (not mentioned in confirmed quote) increase leading up to the deadline

   –  Decline requested additional deliverables if work and time capacity do not allow for it

   –  Decline requested additional deliverables if there is any form of unfair demand/bullying/manipulation/capacity overload 

   –  *Decline any project if there is any form of unfair demand/bullying/manipulation/capacity overload  

 
JPDesign will prioritise projects according to:

  1.  Written confirmation and 50 % deposit

  2.  First Confirmed First Served basis

  3.  Currently running paid-for projects

  4.  Projects confirmed in advance 90 day to 6 months *please see Rush Order Surcharges

Clients do not have the right to wager/bargain/decide/:

 – How much capacity JPDesign has available

 – How much JPDesign should be charging. 

JPDesign will not tolerate any form of time/fee/capacity manipulation or bullying. Proceeding with work wil be terminated should this be experienced at any point.

 

CONTENT , COPY + PRINTING and MANUFACTURING 

  –  All content/wording is to be supplied by client, and must be spelling and grammar checked. 

  –  Printing and manufacturing cost will be stipulated in the quote per project. If a quote is accepted (verbally, via electronic text) a non-refundable 50% deposit is required for the project to commence. The remaining 50% of the project quotation total will be due upon completion of the work prior to the sharing/release/courier of materials with client.

JPDesign will not be responsible for :

  –  Errors picked up after printing/manufacture as design drafts + final versions would have been made visible to client prior for thorough checks. 

  –  Printing/Manufacturing costs associated with client changes/corrections to items once final design and printing/manufacturing has been completed. The client will be charged for the additional printing/manufacturing accordingly.

Across BOTH design and printing/manufacturing, a separate charge will be added to existing invoice/balance payable if:

New Designs are required over and above the agreed scope of work/design/production, OR Requested Changes to existing design exceeds 60 mins

 

CANCELLATION (FEES) OF WORK 

(1) If a project has been accepted or 50% non-refundable deposit has been paid and

DESIGN WORK/MATERIALS TO BE ORDERED/MANUFACTURING HAS NOT STARTED but client does not want to proceed with the project,

      –  the client will not be liable for a cancellation fee. The 50% deposit paid will not be refunded.

(2) If a project has been accepted or 50% non-refundable deposit has been paid and

DESIGN WORK/MATERIALS ORDERED/MANUFACTURING HAS STARTED AND IS IN PRODUCTION  but client does not want to proceed with the project,

      –   the client will be invoiced a CANCELLATION FEE of: 50% of the balance still owed/payable to be paid within the following 30 days.    

(3) If a project has been accepted or 50% non-refundable deposit has been paid and

DESIGN WORK IS COMPLETE /MATERIALS ORDERED/ITEMS MANUFACTURED/FULL PROJECT IS COMPLETE TO REQUIRED BRIEF but client does not want to proceed with the project,

      –  the client will be liable to pay the full amount owed for the project i.e. the full 50% balance owed/payable to be paid within the following 30 days.    

–  Legal action will be pursued should this cancellation fee remain unpaid. 

 

There will be no cancellation of work/refund of project if all items of a project have been fulfilled, complete and delivered.

  –   If a client has received any CCIP materials from JPDesign BEFORE receiving a formal quotation or paying the non-refundable deposit [eg a mood-board for visual direction] and does not want to proceed with the project, but is now in ownership of CCIP materials –  the client will be invoiced a CANCELLATION FEE of: Rate per hour worked on item/s up until notice.

 

EASEL + BOARD HIRING
JPDesign hires out natural wood easels for weddings and events at the following rates:
R 89 for Medium (fits an A3) – Natural Wood

R 99 for Large  (fits an A2/A1) – White

R 129 for grande (fits A1/A0) – Natural Wood

 

The easels are strong and reliable, however they should be handled with care.
  –  Any damage to an easel will amount to a ‘Damage Fee’ of R500.00
It is the responsibility of the client to:
–  Pay the full rental amount as specified in the invoice before collecting items
Collect items from and return items in their same condition to :confirmed address based on availability
Collection/Return of easel/s will be available/required 14 days prior/post wedding date.

– If easel/s are not returned by specified date, the full hire amount will be charged per day that the easel has not been returned.
